Rental Waiver

Rider Responsibilities

I understand that riding an e-bike carries risks. I agree to ride safely, follow NZ road rules, wear a helmet at all times, and operate the bike with care.

Condition of the Bike

I confirm the bike and accessories have been supplied in safe working order. I will tell Waiheke Cycles immediately if something feels unsafe or stops working.

Proper Use

I agree not to:

  • Ride on beaches, through seawater, rivers, or deep puddles

  • Ride off-road on rough tracks, down stairs, or in reckless ways

  • Tamper with speed settings, batteries, or electronics

  • Carry passengers (unless the bike is designed for it)

  • Perform skids, drifting, brake-locking, or any deliberate actions that cause excessive abnormal wear to the bike

Excessive sand, dirt, or water may incur cleaning/repair fees. Tyres damaged by skids must be replaced at the renter’s cost.

Damage, Loss & Fees

I accept responsibility for:

  • Damage caused by misuse, crashes, or negligence

  • Loss or theft of the bike or accessories

  • Water damage, electronic damage, or sand contamination

  • Flat tyres caused by misuse (e.g., curbs, skids, off-road riding)

Normal wear and tear is on us,
If the bike is lost, stolen, or returned unsafe, I agree to cover repair or replacement at fair market value.

Child Seats & Young Passengers

Child passengers must:

  • Be at least 12 months old

  • Be able to support the weight of their own head while wearing a helmet

  • Weigh no more than 22kg

  • Wear an approved helmet and closed-toe shoes at all times

Before departure, Waiheke Cycles staff will fit the child seat and explain harness use, foot straps, mounting/dismounting, and handling considerations specific to carrying a child passenger on an e-bike.

Child seat use is limited to sealed roads and suitable shared-use paths only. Riding on unsealed roads, rough tracks, beaches, stairs, or sections of the eastern Man O’ War loop is not permitted.

I understand that carrying a child passenger changes the handling and braking characteristics of the bike and accept responsibility for the child passenger during the rental period. I acknowledge that cycling carries inherent risks, and to the fullest extent permitted by New Zealand law, I agree not to hold Waiheke Cycles liable for injury, loss, or damage arising from use of the bicycle or child seat equipment, except in cases of gross negligence or intentional misconduct.

Battery Care

I understand battery range varies with hills, rider weight, and assist level. I will follow charging instructions and keep the bike/battery out of extreme heat.

Late Returns

Late returns may incur additional charges. I will notify Waiheke Cycles if I am delayed.

Personal Liability

I accept that riding is at my own risk. Waiheke Cycles is not responsible for injury, damage, or loss to myself, my property, or others arising from my use of the bike.

Road Rules & Alcohol

I will follow NZ road rules and will not ride under the influence of alcohol or drugs.

Security

I am responsible for locking the bike with the lock provided. Bikes must not be left unsecured or unattended overnight unless safely stored.

Cancellations / Refunds

I understand that cancellations and weather changes follow Waiheke Cycles’ terms and conditions.
